1. Introduction
These Terms and Conditions govern your use of the Marbella Holidays website and the booking of holiday rental properties managed or listed by Marbella Holidays. By accessing our website or making a booking, you agree to be bound by these terms. Please read them carefully before proceeding.
2. Definitions
"Marbella Holidays" refers to our company, its staff, and representatives. "Guest" refers to any person making a booking or enquiry through our platform. "Property" refers to any holiday rental accommodation listed or managed by Marbella Holidays. "Booking" refers to a confirmed reservation of a property.
3. Bookings and Reservations
All bookings are subject to availability and confirmation by Marbella Holidays. A booking is only confirmed once you have received written confirmation and any required deposit has been received. We reserve the right to decline or cancel any booking at our discretion. Bookings made by persons under the age of 18 are not accepted.
4. Payments
Payment terms will be communicated at the time of booking. A deposit may be required to secure your reservation, with the remaining balance due prior to arrival. We accept major credit cards and bank transfers. All prices are quoted in Euros (€) and include applicable taxes unless otherwise stated.
5. Cancellation Policy
Cancellation policies vary by property and are clearly communicated at the time of booking. Cancellations must be made in writing via email to info@marbellaholidays.es. Refunds, where applicable, will be processed within 14 business days. We strongly recommend purchasing travel insurance to protect against unforeseen cancellations.
6. Check-in and Check-out
Standard check-in time is 3:00 PM and check-out is 11:00 AM, unless otherwise agreed. Early check-in or late check-out may be available subject to availability and additional charges. Guests must present valid identification upon check-in.
7. Guest Responsibilities
Guests are responsible for the proper care and use of the property during their stay. Any damage caused to the property, its contents, or surrounding areas must be reported immediately and may be charged to the guest. Guests must comply with property rules regarding noise, occupancy limits, pets, and smoking. Illegal activities on the premises are strictly prohibited.
8. Occupancy
Properties may only be occupied by the number of guests stated in the booking confirmation. Unauthorised additional guests are not permitted and may result in immediate termination of the rental without refund. Subletting or assigning the property to any third party is not permitted.
9. Property Access
Marbella Holidays and its representatives reserve the right to access the property at any reasonable time for inspections, maintenance, or emergencies. We will endeavour to provide advance notice except in emergency situations.
10. Liability
Marbella Holidays acts as an agent or manager for property owners and accepts no liability for personal injury, loss, or damage to personal belongings during your stay, except where such liability cannot be excluded by law. We are not responsible for any issues caused by third-party service providers, utility failures, or circumstances beyond our control.
11. Complaints
Any complaints or issues must be reported to Marbella Holidays as soon as possible during your stay so that we have the opportunity to resolve them. Complaints made after departure may not be considered. You can reach us at info@marbellaholidays.es or by telephone.
12. Force Majeure
Marbella Holidays shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, government actions, pandemics, strikes, or other events of force majeure.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Spain. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Marbella, Málaga, Spain.
14. Changes to Terms
Marbella Holidays reserves the right to update or modify these Terms and Conditions at any time without prior notice. The current version will always be available on our website. Continued use of our services following any changes constitutes your acceptance of the revised terms.
